Trembly Law Firm Marks 10 Years Of Protecting Honest Business Owners

Ten years ago, Brett Trembly had a vision. A graduate of the University of Miami Law School, he wanted to help honest business owners in his adopted hometown keep themselves and their companies out of the legal danger zone. He realized that by protecting them, he would protect and nurture the economy of South Florida while also creating long-term relationships within the community. He wanted to do something that he believed was different from what any other law firm was doing. So, he decided to launch his own.

Today, the Trembly Law Firm celebrates their 10th Anniversary. The firm is thriving with three offices in South Florida, has added over the years a Managing Partner in Christian E. Rodriguez, Esq., and Partners Elias Correa Menendez, Esq. and Arturo L. Arca, Esq., and built a team of dedicated lawyers, paralegals and staff focused on “Protecting the Economy, One Business at a Time.®” The firm was recently named to the prestigious Inc. 5000 list of fastest-growing private companies in the US for the second consecutive year.

Significant Case Wins, Jury Verdicts, and Milestones

Over the past ten years, Trembly Law Firm has achieved significant case wins, jury verdicts, and milestones, including three trial wins in four months in 2018. In March of 2018, the Trembly Law team led by Partner Christian E. Rodriguez, who joined the firm on March 15, 2017, secured a Directed Verdict during a bench trial in the defense against Repeat Violence and Stalking Injunction before Judge Donald “DJ” Cannava in Miami-Dade County Court. The case stemmed from a dispute between two business owners.

In April 2018, after two-and-a-half days of arguments before a jury, the Trembly Law litigation team secured a complete defense verdict for their clients. After closing on the purchase of a business, the seller failed to meet several obligations, defaulting on the purchase contract. Nevertheless, the seller brought suit against Trembly Law’s client for breach of contract. When the parties were unable to settle, the defendant countered for misrepresentation, and the litigation team at Trembly Law prepared for trial, leaving no stone unturned. “The Trembly Law Firm successfully represented my business after a horrific three-year struggle and returned my family’s ‘peace of mind’ for the first time,” said the successful defendant and purchaser of the business. “I wholeheartedly recommend the Trembly Law Firm and its expert staff. The Trembly Law team won another jury trial before Judge Thomas Rebull in Miami-Dade Circuit Court in July 2018. Their client had purchased a business with her life savings, and her boyfriend was supposed to reimburse her half of the money in return for 50% of the business. Instead, the boyfriend took control of the business and refused to pay. However, Trembly Law Firm’s litigation team brought this case before a jury to vindicate the client approximately three years later. After about two days of trial, the jury returned with a verdict for the firm’s client above the amount requested.

That same year, Trembly Law reached two critical milestones with the addition of Partner Arturo L. Arca on May 7, 2018 and the firm’s move into their penthouse at 9700 South Dixie Highway in Miami on June 5, 2018. Additionally, Partner Christian E. Rodriguez helped a client secure $600,000 back from a bank after the bank authorized fraudulent wire transfers.

The following year, in 2019, Partner Christian E. Rodriguez and the litigation team secured a complete defense jury verdict in a pregnancy discrimination lawsuit. That same year, the Litigation team also helped a chain avoid a TCPA (Telephone Consumer Protection Act) Class Action Lawsuit and represent the American subsidiary of a large European company in securing a non-compete injunction against a former executive in an arbitration.

In 2020, the Litigation department also obtained a commercial foreclosure verdict and attorney’s fees and costs for a private lender whose borrower defaulted and refused to pay or vacate the premises and defended an appeal in the Third District Court of Appeals of Florida regarding an inconsistent jury verdict.

Fair Labor Standards Act Case (FLSA)

In February 2020, Trembly Law Firm successfully defended a large mortgage originator client against an FLSA overtime and minimum wage claim in arbitration and obtained an important ruling that a mortgage loan originator was an exempt employee under the FLSA. Trembly Law Firm’s litigation team successfully convinced the arbitrator to find that the mortgage loan originator was an outside salesperson, exempt from the requirements of the FLSA. The arbitrator was persuaded by the argument that the claimant could not unilaterally change his duties and obligations without notifying his employer and then file a “gotcha” FLSA claim.

Additionally, Trembly Law has settled numerous FLSA and ADA (Americans with Disabilities Act) cases for clients, saving them from costly litigation which could have had disastrous consequences.
