Trembly Law Firm Successfully Defends Appeal in the Third District Court of Appeals of Florida Regarding Inconsistent Jury Verdict
Trembly Law Firm was hired by the defendants/appellees to defend against an appeal to the Third District Court of Appeals from an order granting defendants’ motion for new trial based on an inconsistent jury verdict. The jury found that the plaintiffs/appellants were negligent but inexplicably failed to apportion any fault to the plaintiffs/appellants but instead allocated 100% of the fault to defendants/appellees. Additionally, the jury found that the plaintiffs/appellants were not harmed by an alleged fraudulent transfer of the defendants/appellees but again, inexplicably, awarded plaintiffs/appellants monetary damages.
The Firm’s litigation team, headed by Veronica Rabinowitz, quickly and diligently defended the appeal, and ultimately the appellate court agreed with the Firm’s arguments. Trembly Law Firm argued that the ruling of the trial court in ordering a new trial was proper as the jury verdict was fundamentally and wildly inconsistent with no available remedy other than a new trial.
Appellants filed a Motion for Rehearing en banc, which was denied by the appellate court.
The case will now return to the lower court, where Trembly Law Firm intends to represent the defendants in the new trial.
